Terms of service
General Terms and Conditions and Customer Information
I. General Terms and Conditions
§ 1 Basic provisions
(1) The following terms and conditions apply to contracts you conclude with us as the provider (stilfaser GmbH) via the website www.jungfeld.com. Unless otherwise agreed, any terms and conditions you may use are hereby contradicted.
(2) Consumer within the meaning of the following regulations is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. Entrepreneur is any natural or legal person or a partnership with legal personality who, when entering into a legal transaction, acts in exercise of their trade, business, or profession.
§ 2 Formation of the contract
(1) The subject matter of the contract is the sale of goods.
(2) By placing the respective product on our website, we make a binding offer to conclude a contract via the online shopping cart system under the conditions specified in the item description.
(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the "shopping cart". You can access the "shopping cart" using the corresponding button in the navigation bar and make changes there at any time.
After clicking the "Checkout" or "Proceed to Order" (or similar) button and entering your personal data as well as payment and shipping conditions, you will be shown the order data as an order overview.
If you use an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will either be directed to our online shop's order overview page or to the website of the provider of the instant payment system.
If you are redirected to the respective instant payment system, you will make the appropriate selection or enter your data there. Finally, the order data will be shown to you as an order overview on the provider's website of the instant payment system or after you have been redirected back to our online shop.
Before submitting the order, you have the opportunity to review the information in the order overview again, change it (also using the "back" function of your internet browser), or cancel the order.
By clicking the corresponding button ("order with obligation to pay", "buy" / "buy now", "order with obligation to pay", "pay" / "pay now" or similar designation), you place a binding order for the goods contained in the shopping cart.
(4) The processing of the order and transmission of all information necessary in connection with the conclusion of the contract is usually carried out by email, partly automated. Therefore, you must ensure that the email address you provide to us is correct, that the receipt of emails is technically ensured, and in particular, that it is not prevented by SPAM filters.
§ 3 Term of the contract / Termination in subscription contracts
(1) The subscription contract concluded between you and us has the agreed term. If the contract is not terminated by one of the parties in text form (e.g., email) at least 3 weeks before the end of the contract period (unless a different deadline is stipulated in the respective offer), it will automatically renew for the agreed basic term. If the basic term exceeds one year, the contract will only be renewed for one year each time.
(2) The right to terminate the contract without notice for good cause remains unaffected.
§ 4 Special agreements on offered payment methods
(1) Payment via SOFORT / Sofortüberweisung
When selecting the payment method SOFORT / Sofortüberweisung, payment processing is carried out via the payment service provider Sofort GmbH (Theresienhöhe 12, 80339 Munich, Germany; "SOFORT"). Sofort GmbH is a company of the Klarna Group (Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden). To use the payment method SOFORT, you must have an online banking account that supports this payment method. During the payment process in the context of the order, you must accordingly authenticate yourself and confirm the payment instruction to SOFORT. Your bank account will be debited immediately after placing the order. For more information about SOFORT, please visit https://www.klarna.com/sofort/.
(2) Payment via Klarna
In cooperation with the payment service provider Klarna Bank AB (publ) (Sveavägen 46, 111 34 Stockholm, Sweden; "Klarna"), we offer the following payment options. Payment is made to Klarna:
Invoice ("Pay Later"): The Klarna invoice conditions for Germany can be found at https://cdn.klarna.com/1.0/shared/content/legal/terms/0/de_de/invoice; the conditions for extending the payment deadline can be found at https://cdn.klarna.com/1.0/shared/content/legal/terms/0/de_de/due_date_extension.
The use of payment methods such as invoice and/or installment purchase and/or direct debit requires a positive credit check. Therefore, we forward your data to Klarna as part of the initiation and processing of the purchase contract for the purposes of address and credit checks. Please understand that we can only offer you those payment methods that are permissible based on the results of the credit check.

§ 5 Right of retention, retention of title
(1) You can only exercise a right of retention to the extent that it concerns claims from the same contractual relationship.
(2) The goods remain our property until full payment of the purchase price.
§ 6 Warranty
(1) The statutory warranty rights apply.
(2) As a consumer, you are requested to check the goods promptly upon receipt for completeness, obvious defects, and transport damage, and to promptly notify us and the carrier of any complaints. Failure to do so will have no effect on your statutory warranty claims.
(3) If a characteristic of the goods deviates from the objective requirements, the deviation shall only be deemed agreed if you were informed of it before submitting the declaration of intent by us and if the deviation was expressly and separately agreed between the parties to the contract.
§ 7 Choice of law, place of performance, jurisdiction
(1) German law applies. For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country where the consumer has their habitual residence (favorability principle).
(2) The place of performance for all services under the business relationship with us and jurisdiction is our registered office, provided you are not a consumer but a merchant, a legal entity under public law, or a special fund under public law. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if your domicile or habitual residence is not known at the time the action is filed. The authority to also appeal to the court at another statutory place of jurisdiction remains unaffected.
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods explicitly do not apply.
